General Terms & Conditions

Terms & Conditions for Purchase of our Tour Packages


Requirement for safe traveling during the pandemic, each traveler to :

 

  1. Be fully vaccinated against Covid-19 with the booster jab taken at least 14 days before tour departure date.
  2. Adhere to rules relating to pandemic prevention as stipulated by the authorities of each destination country, the airline and Malaysian government (as where you are basis), including with regards to rules on wearing of face mask.
  3. Wear a face mask when aboard the out van / bus or on a ferry / tour boat.
  4. Purchased a travel insurance policy with added pandemic cover vaild for the period of the tour.  As terms & conditions may vary between different travel insurance policies, it is the traveler's duty to understand the terms of the travel insurance he/she has purchased.
  5. Bring along a credit card with sufficient credit limit to be used in care of unforeseen emergencies requiring payment amounts above the norm.
  6. Isolate from the tour group and discontinue with the tour if one is tested Covid positive.  The airline will not allow a Covid positive flyer from boarding a flight, therefore he/she will need to be quarantined in a hotel or hospitalized (subject to mefical severity & necessity) in the destination country until recovery (verified by another Covid test).  Any additional costs incurred due to isolation and quarantine (such as separate transfer arrangements medical tests, hotel quarantine costs, etc.) shall be borne solely by the affected traveler.
  7. To consult his/her insurance agent for the coverage details of travel insurance policy.  For AXA Travel Insurance with added pandemic cover, it covers costs of hospitalization for Covid-19 treatment.  However, it does not cover other costs mentioned in (6)(such as hotel quarantine).

 

What is included in the Tour price?

 

  1. The inclusions and exclusions will be as stated in the respective tour itineraries. Where tours require El Sol Travel & Tours Sdn Bhd ("El Sol") to make the air tickets purchase, unless the payment is received in full to enable the air ticket purchase, customers must be aware that the price of air tickets and relevant airport taxes or fuel surcharges, if any is subject to fluctuations. Where there are currency fluctuations, El Sol reserves the right to pass such cost back to customers.

  2. El Sol strives to improve itineraries, services and features. If improvements can be made or where circumstances require changes to be necessary (for e.g. local conditions or weather), El Sol reserves the right to modify the itinerary. Where the changes are needed (for e.g. due to changes of flight times by airlines and say, an additional night accommodation is now required), El Sol reserves the right to pass such cost back to customers.

  3. Customers must be aware that once a tour is confirmed, in order for El Sol to secure the necessary accommodation or services, El Sol would have to prepay for such accommodation or services well in advance of the tour. In the unfortunate event that a tour needs to be curtailed, El Sol will use its best endeavours to obtain refunds or credits for unconsumed services, if any and customers will only be provided with such refunds or credits only if El Sol is successful in its endeavours.

  4. Travel is personal and each individual’s goals and experiences may differ. Whilst El Sol will use its best endeavours to make every tour as enjoyable as possible, El Sol cannot be held liable if the tour experience does not meet with an individual’s expectation.

Reservations and Payments

  1. Your tour will be confirmed by El Sol upon receipt of a non-refundable deposit, the quantum will vary between tours. The deposit is, in most instances non-transferable; any transferability, if allowed, is entirely at the sole discretion of El Sol who will consider, inter alia, factors like whether air tickets have already been purchased.

  2. The balance of the tour will need to be paid in full on or before the respective payment deadlines listed in the respective tour itineraries.

Cancellations & Cancellations fees

  1. In the event any confirmed participant who pulls out after full payment has been made

    (i) the deposit paid will be forfeited; and

    (ii) balance payment, will be reviewed on a case to case basis and a confirmed participant may be able to get a partial refund of amount paid subject to airline cancellation and charges and ground operators’ cancellation and charges.

  2. In the event any confirmed participant who pulls out after the deposit has been made, the deposit paid will be forfeited.

  3. El Sol strongly encourages participants who have signed up for any tour package to purchase travel insurance to cover instances where a confirmed participant needs to cancel a tour booked due to necessary and unavoidable circumstances provided that the terms and conditions imposed by the insurance company are met.

Cancellation of tours by El Sol

  1. If El Sol cancels a tour, all payments made will be refunded without interest.
